General Conditions of Sale

Article 1. Scope of the General Terms and Conditions of Sale

The present general conditions transmitted to the Customer form a contractual whole and constitute the entirety of the contractual relations intervening between the Campsite and its Customers. They govern the sale of holidays by the Campsite and are valid at the time the order is placed, to the exclusion of all other conditions.

The Campsite reserves the right to modify its terms and conditions at any time. However, the version applicable to the customer is the one accepted at the time of booking.

Article 2. Acceptance of the General Terms and Conditions of Sale

The Customer is deemed to accept the present General Terms and Conditions of Sale without reservation, in accordance with the provisions of article 1126 of the French Civil Code. The Customer is hereby informed that, by ticking the box “I confirm that I have read the General Terms and Conditions of Sale” when placing an order on the Internet, or by receiving the booking confirmation e-mail to which the present terms and conditions are attached, he/she gives his/her specific, free and informed consent, particularly with regard to the use of personal data. This unreserved acceptance is valid both for the Customer and for any person taking part in the holiday. The present General Terms and Conditions of Sale are also available on the Campsite website and at the Campsite Reception.

Article 3. Reservation

3.1 Booking conditions

Booking method – The customer can book online, by telephone or at the campsite.

Validation of reservation – All reservation requests are considered definitive once they have been accepted by the campsite. The Campsite is free to refuse a reservation based on availability or any other circumstance likely to affect the planned stay.

Reservations are accepted only by sending a booking confirmation by e-mail, post or hand-delivery. In order to be validated, all reservations must be accompanied by a deposit including :

  • A deposit of 30% to 100% of the total cost of the stay, depending on the reservation date;
  • Booking fees ;
  • Any cancellation/interruption insurance fees.

Electronic signature applicable to online sales – the online provision of the customer’s credit card number and the final validation of the order will be deemed proof of the customer’s agreement to the payment of the sums due for the reservation and express signature and acceptance of all operations carried out.

Capacity and participants in the stay – The reservation is nominative. The customer must be over 18 years of age, participate in the reserved stay and legally provide the surnames, first names and dates of birth of all participants, including minors and newborns.

The campsite reserves the right to refuse any person not registered at the time of booking.

Incorrect information may result in cancellation of your stay.

Because of the personal nature of the reservation, it may not be transferred or sublet in whole or in part without the prior express written consent of the Campsite.

For safety and insurance reasons, the maximum number of occupants per type of accommodation/site, as described in the brochure and on the website, must be respected. The campsite will refuse to accept anyone exceeding this capacity (including newborn babies), with the exception of any visitors invited by the customer for the day.

Group – The campsite offers family-oriented holidays, with accommodation specially designed for this purpose. The campsite reserves the right to refuse any booking that does not correspond to the capacity of the accommodation offered.

The Campsite considers any booking(s) of 3 or more rental accommodations / pitches made by the same natural person or by different natural persons who know each other and are traveling together for the same reasons, on the same dates and on the same campsite to be a group. All requests for group bookings must be sent by e-mail to contact@verdon-les-grands-domaines.com or by telephone to 06.12.07.96.31 (price of a local call depending on your operator), specifying that the request is for a group booking. The campsite reserves the right to examine the request before accepting or refusing it.

3.2 Important information

Minors – For obvious reasons of safety (swimming pool, evacuation of the campsite in the event of an alarm, etc.) and health (hospitalization, etc.), minors not accompanied by their legal guardians, as defined in article 389 of the French Civil Code, are not admitted. Furthermore, in accordance with Decree 2002-883 of May 3, 2002, the Campsite is not authorized to provide group or individual stays outside the family home for minors under the age of 18, unaccompanied by one of their legal guardians. Minors accompanied by their legal guardians are the sole responsibility of the latter, and must under no circumstances be left unsupervised on the campsite premises (including the water park).

Non-contractual nature of communication media – All documents other than these General Terms and Conditions of Sale, and in particular catalogs, prospectuses, advertisements and notices, are for information purposes only and are non-contractual. Plans and photos of rental accommodation are provided for illustrative purposes only. The layout and characteristics of the rooms may vary from one model to another. Please refer to the written description of the accommodation available in the accommodation section of the campsite website for the exact composition of each rental accommodation. A description is also available inside each rental accommodation. If you have any questions, our reservation center is at your disposal on 06.12.07.96.31 (price of a local call depending on your operator).

Campsite facilities and activities – It may happen that certain activities and facilities offered by the campsite (directly or through service providers) such as wifi or elements of the water park, listed in the description, are withdrawn, particularly for climatic reasons or in cases of force majeure, or do not operate, particularly in early and late season. The Campsite cannot be held liable in such cases. The Campsite will inform the Customer of any work / contingencies / improvements undertaken during the stay.

Article 4. Prices

The applicable prices are those indicated at the time of booking by telephone, on the Internet or at the campsite. They are subject to change during the season and are in euros, including VAT.

Any subsequent change in the applicable VAT rate, occurring between the time the rates were determined and the billing of the stay, will result in a proportional change in the price including VAT, which the Customer accepts without reservation.

Price includes :

  • Rental of the pitch or fully-equipped rental accommodation as defined in the brochure and on the websites;
  • Water, gas and electricity consumption (excluding any recharging of an electric vehicle using the domestic socket on its pitch);
  • Access to the campsite, its facilities and activities (except list below) as defined in the brochure and on the websites;
  • Parking space for one car per rental (not necessarily on the rental site).

Price does not include :

  • Application fees ;
  • The various taxes ;
  • Paid activities offered by the campsite to be paid on site;
  • Supplements such as cleaning costs ;
  • Security deposits ;
  • The guarantee of a precise location;
  • Cancellation / interruption insurance ;
  • Optional equipment.

Article 5. Terms and conditions of payment

5.1 Terms of payment

The full price of the stay is due:

  • 30 days before the start of your stay ;
  • Or immediately for bookings made less than 30 days before the start of your stay.

In the absence of full payment by the agreed date, the Campsite is entitled to consider that the Customer has cancelled the reservation and retain any sums already paid.

For groups, payment terms are specified in the contract sent with the reservation.

5.2 Payment methods

The methods of payment of the deposit and/or the total amount of the stay accepted by the campsite vary according to the date of payment:

  • If payment is made at least 30 days prior to arrival, payment can be made by credit card, bank transfer, vacation vouchers (sent by recorded delivery with acknowledgement of receipt) or connect vacation vouchers, and euro cheques (sent by recorded delivery with acknowledgement of receipt).
  • If payment is made between 29 and 15 days before the arrival date, payment can be made by credit card, bank transfer or vacation vouchers connect.
  • If payment is made between 14 days and the day before arrival, payment can be made by credit card or bank transfer.
  • For payment on site: customers can pay the balance by credit card, cash or vacation vouchers. Cheques are not accepted on the campsite.

5.3 Details on credit card payments

Credit cards accepted are Carte Bleue, (Visa, Eurocard/Mastercard). American Express is not accepted. The transaction is immediately debited from the customer’s credit card after verification of the card details. In accordance with article L.132-2 of the French Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. By communicating his/her credit card details either online or by telephone, the Customer authorizes the Campsite to debit his/her credit card for the amount of the deposit or the total amount of the stay. To this end, the Customer confirms that he/she is the holder of the credit card to be debited and that the name on the credit card is indeed his/her own. In the event of fraudulent use of the credit card, the Customer is invited to contact our reservation center on 06.12.07.96.31 (price of a local call according to your operator).

Article 6. Services not included in the price

6.1. Application fees

Booking fees are payable per booking. This fee is set by the campsite at the time of booking. They are payable at the time of booking and are non-refundable.

6.2. Tourist tax

The tourist tax is collected on behalf of the municipality of Saint-Laurent-du-Verdon. The amount, determined per person per day, varies according to destination, and may be modified during the year.

6.3. Paid activities offered by the campsite to be paid for on site

Certain activities offered by the campsite or one of its service providers are optional and subject to a charge. Please note that access to the campsite’s water park is not a chargeable activity. If you have any questions, our reservation center is at your disposal on 06.12.07.96.31 (price of a local call depending on your operator).

6.4. Household expenses

The Customer may request that the departure cleaning be carried out by the Campsite for a cleaning fee of a variable amount depending on the range of accommodation no later than 48 hours before departure. The cleaning fee does not include the cleaning of dishes and kitchen utensils, and garbage cans must be disposed of.

For the use of gas planchas/barbecues, if they are not in an acceptable state of cleanliness at the time of departure, a lump sum of €50 will be deducted from the security deposit to cover cleaning costs.

6.5. Security deposit

For all stays at the campsite, a security deposit of 100€ for pitches (in the case of fridge and/or plancha rentals) and 250€ for rental accommodation will be required no later than the day of arrival at the campsite. Payment can be made by credit card or cheque. The deposit will be returned in full on the day of departure, or within two weeks of departure at the latest, once the campsite has been cleaned and the equipment has been left in a satisfactory condition. If this is not the case, the entire deposit will be deducted. Any damage in excess of the amount paid as security deposit will be charged to the customer after deduction of the security deposit. In the event of a cash deposit, and if the Customer wishes to have the amount returned immediately upon departure, it is the Customer’s responsibility to make an appointment no later than the day before departure in order to carry out an inventory of the accommodation.

6.6. Precise location guarantee / Preferred location option

Pitches are allocated by the campsite according to availability, in order to optimize planning. This allocation may be changed at any time before the keys are actually handed over. Only the location, dates and type of accommodation are guaranteed, unless the customer chooses the “Preferential pitch” option. If the pitch of his choice is available or if he wishes to be next to another, it will then be assigned to him and, in return, he will have to pay a fixed price of 30 €.

The campsite cannot be held responsible if the customer does not indicate the correct category of equipment (and its dimensions) when booking and the pitch allocated is unsuitable. Only one piece of motorized camping equipment is allowed per pitch.

6.7. Cancellation / interruption insurance

Cancellation and interruption of stay insurance is offered to customers on an optional basis. It can only be taken out at the time of booking, and is underwritten directly by the Company with : Gritchen Affinity- Société de courtage en assurances Head office: 27 Rue Charles Durand – CS 70139 – 18021 Bourges Cedex – France

It is non-refundable in the event of cancellation. All cover is detailed in the General Terms and Conditions of Insurance and the insurance product information document made available prior to conclusion of the Contract, and also on the www.verdon-les-grands-domaines.com website.

6.8. Prohibition on recharging an electric vehicle using the domestic socket on its site

Even though the campsite is not yet equipped with charging stations for electric vehicles, it is strictly forbidden to charge electric vehicles from domestic sockets on campsite pitches. The campsite’s electrical system, which is dedicated to the operation of the accommodation and infrastructure, is in no way suitable for recharging customers’ vehicles.

Should the Customer fail to comply with the aforementioned ban on recharging, an initial warning will be left on the vehicle. Each time the vehicle is recharged after this warning, a flat-rate charge of €150 (inc. VAT) will be deducted from the customer’s security deposit.

6.9. Optional equipment

The campsite offers optional equipment such as baby kits, fridges, sheets, towels, barbecues, etc. This equipment is available on request and subject to availability. If you have any questions, our reservations department is at your disposal on 06.12.07.96.31 (price of a local call depending on your operator).

Article 7. Partner benefits and promotional offers

Promotional offers are subject to certain conditions and cannot be combined unless otherwise stated. Partner benefits and promotional offers cannot be applied to a booking that has already been paid for in full or in part. On these occasions, customers may have paid different prices for the same stay.

Customers who have paid the higher price will under no circumstances be entitled to a refund of the difference between the price they have paid and the promotional price. In order to benefit from a partner advantage, the customer must prove that he/she has benefited from the said advantage in accordance with the provisions agreed with the supplier. Holders of “partner” benefits must be holders of the stay. The campsite will verify the applicability of the offer. In the event of fraud, the amount of the discount will be claimed from the customer.

Article 8. Withdrawal

The customer is hereby informed that, in application of article L. 121-20-4 of the French Consumer Code, the sale of accommodation services provided on a specific date or at a specific time is not subject to the provisions relating to the withdrawal period applicable to distance selling. No right of withdrawal therefore applies to the sale of holidays by the Campsite. However, this derogation does not apply to any insurance policies taken out (14-day period in accordance with legal provisions).

Article 9. Modification of reservation / stay

All requests for changes must be made at least 10 days before the start of the holiday. It is the Customer’s responsibility to send a request to the Campsite by registered post with acknowledgement of receipt to the Campsite’s address, or by e-mail to contact@verdon-les-grands-domaines.com.

  • In the event of a request received more than 30 days before the start of the holiday, it will be possible to modify the dates, change the category of accommodation or the supplements for the holiday, subject to availability. If the balance is changed, it will be necessary to pay any supplements before arriving at the campsite. Where changes result in a reduction in the balance, the difference will be reimbursed.
  • Between 30 and 10 days before the start of the stay: changes to dates or type of accommodation will be made according to availability. However, if the balance is less than the initial cost of the stay, no refund will be made.

Changes to supplements (such as pet supplements, linen and towel hire, housekeeping, plancha hire, fridge hire, participants) will not be refunded if the initial amount of the stay is less than the balance.

  • Less than 10 days before the start of your stay: no changes to the dates of your stay or type of accommodation will be made, nor will any supplements be cancelled.

If supplements are added to the stay, payment must be made immediately.

The Campsite will make every effort to accommodate the request according to availability and applicable rates. If the modification is not possible or accepted, the customer will have to make the stay as originally planned or cancel it.

Article 10. Cancellation of stay (not covered by cancellation/interruption insurance)

10.1 Cancellation by the Campsite

Except in cases of force majeure, the stay will be refunded in full. Under no circumstances may this cancellation give rise to the payment of damages.

10.2 Cancellation by the Customer

It is the Customer’s responsibility to notify the Campsite by registered post with acknowledgement of receipt to the Campsite’s address or by sending an e-mail with acknowledgement of receipt to the following address: contact@verdon-les-grands-domaines.com.

The date of receipt of the cancellation will determine any cancellation charges.

In the absence of any written agreement under the aforementioned conditions, the Customer will be liable for payment of all sums due in respect of the reservation.

The applicable cancellation fee schedule is as follows:

  • Before the 61st day inclusive of the stay: 10% of the total amount of the reservation plus ancillary costs (booking fees and insurance) will be charged.
  • Between the 60th and 31st day before the stay: 30% of the total amount of the reservation plus ancillary costs (booking fees and insurance) will be charged.
  • Between the 30th and 16th day before arrival: 50% of the total amount of the reservation plus additional costs (booking fees and insurance) will be charged.
  • Less than 15 days before arrival or in case of no-show: the full amount of the reservation will be charged.

Please note that whatever the cancellation date, the booking fee and any cancellation/interruption insurance subscription fees are non-refundable.

The campsite offers a Cancellation and Interruption of Stay Insurance as an optional extra, through its partner Gritchen Affinity – Société de courtage en assurances Head office: 27 Rue Charles Durand – CS 70139 – 18021 Bourges Cedex – France

For groups, cancellation conditions are specified in the contract sent at the time of booking.

Article 11. Course of the stay

11.1 Arrival and departure times

Camping pitches – Arrivals from 12pm and departures before 11am.

Accommodation rental – Accommodation is available from 4pm and must be vacated by 10am on the day of departure.

In the event that a customer is unable to respect the arrival times, it is the customer’s responsibility to contact Reception immediately to try to find a solution. In the event of non-arrival within 24 hours of the scheduled arrival date and without a written notice sent to the Campsite confirming the date of arrival, the Campsite reserves the right to put the accommodation/pitch up for sale.

No refunds or compensation will be made. No reductions will be made for late arrivals or early departures.

In the event of a delay in handing over the keys / releasing the pitch, an additional night will be charged.

11.2 Length of stay

The minimum length of stay may vary depending on the campsite where the customer is staying, the type of pitch/rental and the period of stay.

The minimum rental period is 2 nights from the opening to the closing of the campsite.

11.3 Check-in / Check-out

Check-in – On arrival, Reception checks the customer’s balance. The customer must have paid the balance in full, present valid official identification and pay the security deposit in accordance with the above conditions. After registering the Customer’s arrival, Reception will give the Customer the keys to the rental accommodation, any Camping access card and regulatory information. It is the Customer’s responsibility to check the inventory on arrival, and to report any discrepancies within a day of arrival.

Check-out – It is the customer’s responsibility to return their accommodation in a clean and tidy condition by 10am. Failure to do so may result in a cleaning charge corresponding to the amount of the cleaning package. Similarly, the customer may be charged for any broken, lost or damaged items during the stay. The security deposit will be returned in accordance with the above conditions.

11.4 Internal regulations

During his stay, the customer undertakes to comply with the campsite rules and regulations, which are available / displayed at reception and on the campsite website. These regulations apply to all persons residing with or under the responsibility of the customer.

Unless otherwise specified in the campsite rules or expressly authorized by the campsite, tents may not be erected on rental accommodation pitches.

In the event of flagrant non-compliance with these rules, the Site Manager may impose sanctions up to and including termination of the contract, especially in the event of disruptive behavior that is contrary to the calm and serenity of the reception area, or in the event of violent behavior or abusive, racist or threatening language directed at other Customers, Campsite staff or its partners or suppliers. Customers are informed that they may also be refused access to accommodation.

11.5 Pets

Two pets are allowed per rental accommodation or pitch, provided they are notified at the time of booking or arrival. Pets are not allowed to roam freely and must be kept on a leash, including on the rented pitch. They are not allowed in the water park, children’s play area or toilet blocks. Animal droppings must be collected by the customer, and their behavior must not disturb the peace and quiet of other customers.

Customers are asked not to leave their dogs alone. Two conditions must be met for animals to be accepted: – valid anti-rabies vaccination (for customers not resident in France) – identification by tattoo or chip attested by a card issued by the Société Centrale Canine. Customers must bring their pet’s health record with them. Dangerous or aggressive animals (including1st and2nd category dogs) and exotic pets are not accepted.

11.6 Noise pollution

In accordance with the Campsite Rules and Regulations and in order to preserve the peace and quiet of other residents, noise pollution is strictly forbidden within the Campsite. Should the Customer fail to comply with the aforementioned prohibition, and after having been reminded orally for the first time and then a second time by hand delivery of a written warning without effect, the Customer may be excluded from the Campsite and prohibited from staying there in the future.

11.7 Visitors

Any visitor invited by the customer must be notified and registered at the campsite reception. Visitors are admitted to the site free of charge, but without access to the water park. Their vehicles are not allowed inside the campsite and must remain in the communal parking lot. The Campsite reserves the right to refuse access to Campsite services. Visitors are bound by the Campsite Rules and Regulations.

Article 12. Liability

The open-air hotel business does not fall within the scope of the liability of hoteliers under article 1952 of the French Civil Code. Consequently, the campsite cannot be held liable for loss, theft or damage to personal belongings, whether on the campsite, in the parking lots or in communal areas (bicycle rooms, sanitary facilities, etc.). Parking is at the customer’s own risk. It is the customer’s responsibility to take out civil liability insurance and, if necessary, to contact his usual insurance company to extend the coverage of his comprehensive home insurance to the accommodation occupied for the duration of the stay.

For all stages of access to the Websites, the reservation process and subsequent services, the Company has only an obligation of means. Although the Camping makes every effort to maintain an operational service, it cannot offer any guarantee as to the continuity of access to its Websites, and consequently declines all responsibility for any direct and/or indirect damage caused by the impossibility of accessing all or part of the Websites, or which may arise from the use of the service by an Internet user. The Campsite may not be held criminally or civilly liable for any consequences resulting from inappropriate or unauthorized use of the Websites or their content by users or any other third party.

The Campsite cannot be held responsible for any false, misleading or erroneous information given in catalogs or on Internet sites concerning the Campsites, in particular presentation photos, descriptions, activities, leisure activities, services and operating dates, as a result of the communication by any third party of photographs for which they have declared they have the rights.

The Campsite may not be held liable for the non-performance or improper performance of the contract entered into, in the event of fault on the part of the Customer, in the event of force majeure or the unforeseeable and insurmountable act of a third party unrelated to the provision of the services provided for in the contract. In any event, should the Campsite be held liable for any reason whatsoever, any compensation shall be limited to the cost of the stay.

Article 13. Claims

Any complaint must be reported to the campsite by the customer during his/her stay, so that the campsite can remedy the non-conformity or take note of it. If the non-conformity cannot be remedied on site, the customer may send a written complaint to Customer Service, who will attempt to remedy the situation. In order to best investigate the complaint, the Customer is requested to provide as soon as possible any factual elements (photographs, videos, etc.) that he/she may be able to gather, unless the non-conformity has been noted on site by the Campsite. Any complaint relating to the Customer’s stay must be sent by post to the Campsite’s address or by e-mail to contact@verdon-les-grands-domaines.com or the Campsite’s e-mail address. No complaint will be taken into account for an incident that has not been reported to the Camping Manager during the stay.

Article 15. Authorization of image rights

During their stay, the Customer and any persons staying with them (hereinafter the “Guests”) may be photographed or filmed within the Campsite for group shots (hereinafter the “Images”), which the Customer accepts on their behalf and that of the Guests. The Customer also authorizes the Campsite, on his/her behalf and on behalf of the Guests, to publish the Images on their social networks for a maximum period of 5 years from acceptance of these Terms and Conditions.

In any event, it is understood that the Customer and the Persons accommodated :

– may revoke the above authorizations by notifying the campsite reception in writing during their stay;

– after the publication of Images concerning them on social networks, may request their deletion by sending an email to the following address: contact@verdon-les-grands-domaines.com

– will not receive any remuneration for the distribution of the Images as provided for in this article 15.

Article 16. Applicable law, jurisdiction and mediation

These General Terms and Conditions of Sale are governed by French law, and any dispute arising from their application shall be subject to the jurisdiction of the Courts of Digne-les-Bains, regardless of the Customer’s country of origin. In the event of a complaint, and after having referred the matter to the Campsite’s customer service department in accordance with the Complaints procedure, the customer may refer the matter to a consumer ombudsman, within a maximum period of one year from the date of the written complaint, by registered letter to the operator.

The contact details of the mediator who may be contacted by the customer are as follows: CMAP (Centre de Médiation et d’Arbitrage de Paris – CCI de Paris) www.cmap.fr.

In application of the provisions of article 1368 of the French Civil Code, it is expressly agreed that data stored in the information systems of the Company and/or its partners have evidential value. Accordingly, any computer or electronic data stored in this way, if produced as evidence by the Company in any litigation or other proceedings, will be admissible, valid and enforceable between the parties.

Article 17. Partial non-validation of the General Terms and Conditions of Sale

Should any clause of these General Terms and Conditions of Sale become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of and compliance with these General Terms and Conditions of Sale.
